Whose duty is it to pay stamp duty to IRAS in a leasing agreement?

The landlord?

The tenants?

The agent of landlord?

The agent of tenants?

Anyone know?

You are required to pay stamp duty if you are the party named in the document to pay the stamp duty..

If the terms of the document are silent on this, under the Stamp Duties Act (Cap 312), the stamp duty will be borne by the tenant and duty on duplicate will be borne by the landlord.

if u are asking who shd be actually GETTING the stamping done.. shd then ask. if dun stamp.. who gets into trouble?

No stamping means no contract, means agent dun earn any commission.

No stamping means no contract, means tenant is tresspassing.

i recently sublet a room (not whole flat) - also need to stamp duty

to be honest, if there any legal issues, it is too expensive to get lawyer and both side will not earn. (who wants to pay $ to lawyer)

Anyone make use of stamp duty to legalize your own issues (or bring up certain issues) ?
