At the same time, after completing all the documents for my new flat, i have forward her all legal proceeding including the documentation of my new flat. Up till today, there was no reply from her which is her ususal self. However, i will suggest ALL prospective buyers not to have any dealings with this flat with all the issues surrounding the flat!   3. Hi berry surprise Yup! In fact.. I was very upset by such replies. As a statutory board and SQC where the quality is the highest, they are giving us such replies. Moreover, they are paid by us (i.e. taxpayers) to help us but these buggers just conveniently push us aside! I believe the opposition party should have a lot of grounds in the next election then...   4. Hi Charemme Yup.. i am really thinking what the **** is the seller thinking. First of all, she is in the wrong, and yet she can be so ridiculous. Then i wrote to HDB stating my situation and asking if they are trying to create a problem. Because if the property prices keep rising, all the sellers will become a potential defaulters and they will be able to go scott free. And if the property prices fall, the buyers will become potential defaults since they are able to bargain for lower price. So in the end, does it mean that HDB will just simply not be bothered with any issues given the authority and power to act it? So what roles does the HDB takes? Regards Spaceboy
  5. Hi Dean Nope. The situation is in such a manner that she has a proven track record that her words cannot be trusted. At first, she approach me to give her $7,000 cash if i still want to pursue buying the flat. We will willing to compromise and she has been agreeing with us to make the deal goes through. However, she will called us back a few days later and we are sincere in privately helping her with $20,000 cash which is our last chance to her. However, greed has overtaken her thoughts and she ask for $40,000 cash. So if you are in my shoe, do you still want to give in to her demands? Regards Spaceboy
  6. Hi Berry Surprise Understand what you have gone into. But i will suggest that you need to sit back and evaluate the situation before making any decision. Be positive and plan ahead. Such incident has already happen and we cannot remain negative. It is not as if we are so stupid enough to get cheat, but there is intention for these people to cheat our hardearned $.   7. Hi Charemme Yup! We definitely cannot tolerate such despicable person in Singapore. She really thinks that her bankruptcy status is something she is proud and encourages her to go further. But she is too ignorant of facts and the law society in Singapore. To share with you, despite all the money that i have thrown into that flat, we have yet to receive a single cent from her or a call from her. It is really shameless! She puts people into deep **** and keeps mum about it. Yes, she really think she can quietly get this done and over. But unfortunately, she has met me. I have serve her my first round of law binding documents last week and there are more to come. Regards Spaceboy
  8. Hi Pinklady From what i have gone through, it is really crazy but one has to be positive in looking forward. If you think about it carefully, HDB has been protecting the interests of the seller in this open market in which i have wrote to them and seek their advice on all the experiences that we have went through. If they are protecting the seller, so where are the disclosures in protecting the buyer? Does it mean that if every seller behaves in such a manner where they will back off with the escalating resale flat prices, they will sit there and continue to watch the resale market prices to escalate further? What role does HDB acts in this instance? Watchdog? Gatekeeper? or relax department? As HDB has claimed that they are reacting and improving, so they should have to react in the very first instance.   9. Hi Scenic98 In this society, i believe that we have to share and help each other. As such, i also believe that there are many young couples out there that are looking at their first home and are innocent of such characters around. That is precisely the reason that i share it out to other forummers so that young couples will learn from our mistakes. Although some people could be mocking at us for being silly and stupid, but once you are being hit, you will really feel the pain. We do understand that the government is trying to protect the bankrupt, but protecting the bankrupt at the expense of our welfare? Resolving one problem but starting another problem? The government should face the fact as to why these bankrupts are being made bankrupts. I am not too sure of other forums then, probably will need your enlightenment on this aspect. If given yourselves to be in my shoe, will you still trust and believe these bankrupts?
  10. Hi Scenic98 Yup.. the agent should bear responsibility for it. You are very rite as there is a cooling period between placing the deposit and signing the OTP, but the seller insists that we have to pay her immediately. I remember clearly that we signed the OTP around 12am in which i have requested to pass her the cheque the very next morning, but she refused and insisted that we passed her the cheque immediately when she signed the OTP. The police cannot do anything much so it was purely for record purposes. This will only become handy if she goes around cheating 1 more buyer. Approaching the MP will be kinda meaningless, since they are very much limited to their scope.
  11. Hi Potluck Yup! No doubt that the agent should bear some responsibility. Although the seller did not disclose these financials to the agent, the agent should have notify us on some unusual events. But things are not looking that good for us also because I have change job after our first appointment with HDB and have submitted a new HLE, but they have come back to us with lots of queries. Sigh:(
  12. Hi blackcar We did ask their agent, why you did not inform us on her background? Her seller agent told us that she did not let her know about the slightest details. Then in the first place, the seller agent should notify us that they did not let her know about the slightest details so that it will be our preorgative to go and find out. But the seller agent told us that she (seller) ask them to bring them around to see the private properties in East Coast. Yup! Precisely, that was what happen in our last heated tele-conversation, i mention that she need to inform us as it is our every right to know and to make decisions and not to hide. Then she say she has no choice and her agent coax her to sell the flat. Well, I refuted, your agent coax you to sell the flat? Are you a 3 year old kid to sign all the legal documents? Common, if the agent coax you to sell, you will not insist the $5k deposit. Then she keep quiet and say, i am sorry and hang up the phone. To me, it was simply plain ridiculous. Regards Spaceboy
  13. Hi Cookiesmonster Yup! With this tech savvy era, we have to try to let it known to as much people as possible to prevent more people from falling into this trap. Although we have lost around $30k, we are still able to take it but what i personally felt despicable is her values and principles. Everything is in the hands of my lawyers already, so we can just wish her good luck. In the end, it will be ugly sight like what is happening and where it will become lose - lose situation.   14. Hi Chronograph That is a good alternative! But what do you suggest that he will do? Tighten up HDB regulations or push it back to their official assignee? If push it back to their official assignee, what do we expect the official assignee to do? Return us the $5k and the case is closed? There is no general guidelines on all these and if we force it to the high court, like what has been mentioned, it will be costly which will not be affordable for the lower income group.   16. Hi Cruise Thank a lot! Yup! In this high technology savvy era, we should take all measures to share and do preventive measures. Yup! It simply reflects our efficiency and effectiveness of how government organisation. I have tried to talk to IPTO (organisation that in charge of bankrupts), but they did not revert back to me even if i tried calling them everyday, sending them emails and leaving voice messages! The receiptionist has say that now bankrupts are able to sell and they do not need to be approve by their official assignee. So where is the comfort level and assurance level or protection level between the buyer and the seller? Simply, the IPTO push it to HDB but both the HDB and IPTO are like brewing a can of worm which can be disastrous! Currently, HDB told me that they will not intervene in such matter where they have already known the behaviour based on the information in their system. Unless HDB is telling me that their system will not be able tracking these information, which simply reflects the efficiency and effectiveness then, so where are their control system?   17. Hi Potluck Congrats on resolving the issues and getting the house! You are very right in making sure that this is not the 3rd or 6th time, but the HDB is not revealing such information to us. Since HDB did not reveal these information to us, that is why we have a police report, so that the police can be alerted once the seller is out to scam buyers. And all it just need to take is to scam one more buyer and it takes is to say good luck to her. I have made a clear to the police once there is one more buyer complaining about her. The intention is very clear already! Thiis is indeed a very painful experience. I have been writing and calling her official assignee too. But seems that they are not keen to even revert back to me.   18. Hi cacabi111 Looking at the way she is behaving and the market situation, if the property market continues to escalate, do you think that she will sell to another buyer? We cannot neglect the sccenario that the another buyer will also be in my same shoe.. Have paid her the OTP, gone through the first appointment, then start to say all the excuses in the world.. The lawyers have already advise me and we have acted accordingly. But we have put the ball back into her court as we have acted legally and we really felt sorry for her for thinking that she can have her way. She thinks she is ruling this country and she can do whatever that she wants. But the manner that we have acted will only act as a preventive measures in others trying to get the flat and a few other actions. Regards Spaceboy

  21. Yup! Tat's right! Moreover, she is a bankrupt, so for her to pay will take ages for her to clear the outstanding dues. Her reply to us is like.. "I am a bankrupt.. so what can you do to us." Although many of you may feel like "wah.. legal fees", which costs around 10k, but we have already lost around $20k (i.e. govt grant and deposit), so there will be more costs involved. And that is not taking into account of if i will be buying a new resale market hdb flat now in Ang Mo Kio in which it has at least increase more than $20k. In the actual fact, i have spell it to her that i have brought my furniture (ard 15k), the rental and utilities (ard 700 per month). That is way back before she told us that she does not want to sell to us. That is also precisely why a lot of people will stop chasing her for the $ in the end. But we will not let her go scott free from all these! she could probably not be aware but in fact, she can continue dream on getting her own way.
  22. Hi Sugardaddy Just suay on my part as she is also the sole owner of the flat. Yup! If not, i will also whack the other owners in this HDB flat as well! I am feeling v sore as there is currently no protection to the buyers. If you look at it, it can actually be a good money making scam. Collect the money first.. then start to twist and turn.. and twist and turn.. make you feel tired and sick of pursuing so that you give up. 1 couple collect $5,000 and if such personality go around convincing 10 couples, that could equate to $50,000 for three months!   23. Yup.. That's right. I have read quite a fair bit.. In fact, for a bankrupt to sell their HDB, the bankrupt do not need to seek clearance from the OA. As such, the OA will usually approve it. Yup! Thats say.. if she goes around collecting $5000, she will actually go scott free because it will b costly to start legal proceeding. I can just simply say that she met the wrong couple to play afool with. A police report has been made and we have done quite a bit of things to her today but definitely through the legal means. Although it is costly, such behaviour is indeed intolerable and unacceptable just because she is a bankrupt. Regards Spaceboy
  24. Yup. Currently, we are going through the legal proceedings in which it will be a long and lengthy legal battle. Instead of telling us that she is a buying a private property for $2 million at East Coast, she should have honest about it when we are negotiating for OTP. This has been a painful lesson for us and we hope to create awareness on this as there are still existence of such people who can behave in such a manner.
  25. Dear all Beware of the above captioned! On 31/5/2009, both the seller and buyer (my wife and I) have agreed and signed the OTP to purchase the HDB flat in which she has ask us for an immediate deposit of S$5,000 to prove our sincerity and to exercise this OTP. As such, I causally ask her what are her plans after selling the flat and she told us that she is buying a private property in East Coast for $2 million. As we did not suspect anything then, we have no choice but to made payment immediately. As set out by HDB, we went for the first appointment (20/7/2009) and signed all the legal documents. However, the HDB officer has told her that there was an outstanding dues from her and she will need to settle it before the HDB can proceed with this transaction. Henceforth, we checked with her what is happening and she just told her that she will made payments to settle the outstanding dues. However, on 11th August 2009, she called us and ask her to meet her the next day to discuss about the HDB flat and outstanding dues to HDB. Therefore, I told her that I will be bringing my agent along, but she has requested to meet us privately instead of calling her agent and our agent involved. We agreed and went over to her place to discuss about the outstanding dues. During the meeting (12/8/09), she mentioned to me that she has an outstanding of S5,000 (deposit that I hand to her) and legal fee ($286) and $14,000 (upgrading fee) that was due to HDB. The conclusion of the meeting was that she was unaware of this outstanding dues of upgrading fee and she requested us to give her time to check and made payments. As a result, I checked with her what are the timeframes that she has set forth and she mentioned that she will settle the issue as soon as possible and made the payments (deposit + legal fees) around 2 weeks time. We agreed and told her to settle the issue as soon as possible. Subsequently, we started to chase after her for the outcome and the outstanding dues to HDB and she will give excuses like “I will make payments by tomorrow” and “tomorrow and tomorrow” until the HDB officer and ourselves starts to get frustrated with it in which we had told her if there are no resolution, we will start our legal proceedings. However, before we wanted to commence the legal proceedings, we did a quick check on her and found out that she was a BANKRUPT since 2001! This was when she called us and wanted to discuss something urgently with us. However, this time round, all the parties are involved in the meeting (29/8/2009) and she told us to help her on the upgrading fees. The conclusion was that she will make payments by Tuesday (2/9/2009) while we will out of goodwill help her with $7,000 for upgrading fee where we thought the worst is over. But the nightmare was to begin when she keep pushing it to “tomorrow… tomorrow” and the HDB officer has write to her saying that if she does not make payments by (10/9/2009), he will cancelled this case. Therefore, on the 10th September, she called us and say that her funds will be coming in and she will be making payments by 11th September after 2pm. I pleaded with the HDB officer and he gives me the last chance to make payments to HDB. However, she called us on the 11th September around 4pm and say that she cannot make payment to us as she has no place to stay. We told her that we will allow her to stay till the 31st December 2009. She insisted and she told us to prepare another OTP (with slightly higher transacted price of $7000) for her to sign. My agent prepared another OTP and went over to her place to let her sign but she give a lot of excuse not to sign the new OTP. Yesterday, she called my agent and myself saying that she wants to cancel the whole transaction in which I told her that it has already been cancelled by the HDB officer citing that both of us have suffered losses and she can actually sell it other prospective buyers at $30,000 more than she can sell to me. When I questioned her of the costs and claims involved in canceling this transaction, she told me she is a bankrupt and she cannot do much. Conclusion: I am writing this to create awareness of such arrogant and unremorseful people in Singapore! Apologies for such lengthy post! Regards Spaceboy
