My tenant rented a room from me for almost 4 years, I decided to give him one month notice effectively next mth, but my Tenancy Agreement ended in April this year and a new agreement was not redrafted after April. Is there any implication if I give him one mth notice to move out? -

I know that bankrupts are limited of a legal capacity to enter into a contract, but can't the other of his/her joint owner do so in order to complete the sale? I don't think that the sales proceeds is handed over to the OA because the HDB property is not vested with the OA if the household nucleus is singaporean, so he/she can keep it. But of course he/she is encouraged to pay part of the proceeds for the benefits of his/her creditors. -
Sorry, don't know whether this Qn has been posted before or not. Understand that once the buyer obtains an option to purchase, the buyer’s lawyer will make both the title and bankruptcy searches of the legal owners. May I know what is the purpose of the bankruptcy search? From the HDB Website, bankrupt sellers (who are singapore citizens) does not require approval before selling his/her HDB property. So what will happen if the buyer or his solicitor found out that the buyer is an undischarged bankrupt?

Because your post is abit different from what bro Warrior88 has posted dated Sep 3 2010, 05:09 PM. He posted for previous owners taking HDB loan, - Got 50% rule, 10% CPF DP. You posted "As you mentioned, total cash proceed is ~120k, so 60k must go to finance your 2nd home. since your new flat is 520k (520k means valuation 490k + COV 30k?), this 60k is enough for the 10% downpayment." So what you mean is if previous owners take up a 2nd HDB loan, and his 50% of his previous resale is sufficient to "cover the 10% downpayment", he does not require to pay the 10% downpayment, just the 50% cash proceeds will do. Is that what you mean? Thanks. -

Hi bro, this 10% downpayment can be paid in CPF if the buyer still have sufficient CPF prior to the sale? Since rini803 mentioned he wish to take HDB loan. Any other new ruling with regards of the "% of downpayment if take HDB loan"? So you were to mean that if rini803 fork out $60k (50% of previous sale) to finance his 2nd home, he does not need to fork out additional of 10% HDB downpayment? Pls advise. -

Hi bepgof, I understand your first answer. But if I have an existing HDB resale flat, surely I have to stay until I get the keys and sell within 6 mths period. So you mean I have to sell my resale before I get the keys in order to siam the 10% cash downpayment? If like that, I will be paying 50% cash proceeds + 10% cash downpayment for my new flat? It's absurd. -

What abt buying new flat direct from HDB, like BTO exercise? I need to pay 50% of my cash proceeds? I saw some information from HDB website. HDB says after 30 Aug 2010, I need to pay 20% of purchase price, 10% cash, 10% CPF for the downpayment? Simi lai de? -

Hi therat, what abt the distribution of HDB flat if the sole owner passed away and he has 2 occupiers as listed? The remaining occupiers are his father and sister. Parents is divorced, mother is not under the name of the HDB.

Or I see. Thanks. So Cash proceeds Down, in other words, the CPF OA will be up? Let's say my dad fully paid up one shot for his 4 room resale 10 years ago. He bought it @ 80k. His flat is estimated @ $380k now. How much cash profits can he get? I understand that from July 2010, the CPF Minimum Sum will be revised to $123,000. So $123k will be kept in his retirement account. Balance will be his cash profits?

Thank you blue_skies, for your feedback. Currently besides UOB, OCBC and Standard Chartered home loan is also under my consideration. I saw this term "SIBOR-pegged Home Loan" from one of the bank. Anyone knows how does this works?
