Please Help..urgent Advice

Recommended Posts

Hi, i rely feel so disappointed with myself, i know its my fault but what has been done cant be undone so i seek your help fellow forumers. i have been reading this forum since two days ago..but i guess i was impatient to wait for a quote from this reasonable guy from a reputable company mention in this forum as it has been more than a week of waiting so i saw a booth exhibit today..

After a very assuring talk from the id or the sales person i just put my deposit without knowing their background. i don know why i act so impulsive..they r very new and at that point of time i just sign. Went back and check their website, even their website not ready yet. Haiz, rely regret my decision, this is rely a bitter lesson for me. i told them i want to cancel and get my deposit. i told them after 2 hours of signing and they told me i cant. and deposit will be forfeited.

Just need advice here. is it true i cant even get my deposit? even i told them just after 2 hours of signing. i don mind paying for their admin fees. If possible i would want to get my deposit and cancel my loan cause just now i also fill up the loan application also. Please offer your sincere advice.. thank you in advance

You should be able to get back your deposit. I remember under consumer law, there is a 7-day cooling period for any products or services we buy. Check it out at Small Claim Tribunal.

Do name the company here and let people know of such unfair practice.

Keep your receipt well, ask them nicely again for the refund, let them know you are aware of a 3 day cooling period for any contract (yokine9a, I'm not sure if it's 3 or 7). if they refuse to heed, tell them you will be making a claim via Small Claim Tribunal.

I have actually told them i wanted to cancel just after two hours u noe but they say i cant. i told them even government body allow us to cancel certain things.

So i decided if i cant cancel, fair enough i will just make use of their service but making use of the deposit small items such as changing toilet bowl or change of doors since its only $500 but to my horror they told me can, but i need to sign black and white with them to say that i cannot renovate my house within 1 year from the date i sign since i told them the reason i want to cancel is due to financial reason. Is this valid?..i find they are putting me at my dead end man.

I would rather lose my deposit than lose thousands over dollars but they say i would have to pay 20% of the agreed contractual amount if i decide to cancel which is stated in the agreement. But fellow forumers some of you may be ID or have experience in renovation firms, please advice if they can actually do this and sue me?..and the paper i sign with them is stated AGREEMENT not QUOTATION and it was written not type written.

The above is really "GANGSTERS".

Did u inform them of your intention to escalate the issue to Small Claim Tribunal?

If u did and still get this kind of reply/attitude, wait no longer, go Small Claim Tribunal to file a compliant.

Hi chronograph, i did tell them tat i will check with CASE since they say i cant get my refund even though i had told them in less than 1 day. So that is wat they told me to sign a contract with them as to not engage any renovation within one year.

I would want to go to CASE or Small claim but i have to know my rights first as a consumer therefore i am actually seeking help to whether i have the right to voice out as i was a willing party and i actually signed on the contract without force. Whether my claims or case will be valid. I find they they are rely not letting me off the hooks man..

Direct sales contracts have a 3-day cooling-off period. Contractors that carry door to door sales like clothes hanger contractor is subjected to 3-day cooling-off period as provided by law under the Consumer Protection (Fair Trading) Act. The 3-day calculation excludes Saturdays, Sundays, and Public Holidays. A transaction is considered as a direct sales contract if it is unsolicited, or if the product or service sold was different from what was requested by the consumer.

Any update on the case?

I'm curious to know the outcome...

Agreeing with Dr.Evil. It might be useful if Rossi can give us a some direct hint of the identity.

I'm sure other fellow forumers will be curious to know too.

I was tricked by a cunning ID during expo show last year. Forfeited almost 1k to them.

The big boss of the company quote: "Did it came to ur mind, whatever contract, any contract you sign, u can just get away Scot free? without breaking any clauses any penalty".

Approached CASE. They told us that its hard to win a battle with the accused just saying(cheating) us verbally. No black n white evidence. Anyway the firm and us gave way and broke the contract but poor us got to pay that sum of almost 1k.

Those interested can search all my posts to find out who I am talking about.

It's really too much for them to do that!! Maybe u can get them to do painting for your house or getting a new set of toiletries from them to make use of your $500..

Did the agreement state anything like forfeited of deposit?

This is a very good lesson for us to learn.. :curse:
