How Long To Marry And Divorce A Foreign Bride?

Recommended Posts

the above case is it when after making a will? :bangwall: why the $$$ will go to the wife's parents and not the HB's parents? :dancingqueen: this is a good idea too that the $$$ will go to the wife's parents. :P

Sorry... it is referring to both of them didn't make a will...

$$$ will only go to the wife's parents only when the wife is younger then the Hb and Hb died first...

one thing to note is that your cpf nomination made before marriage is automatically void if you ROM. means even if you nominate your parents as the beneficiary before marriage, once you sign on the dotted line without making another nomination would mean ALL your cpf money goes to spouse if anything happens...

also note that nowadays insurance companies (except NTUC) usually do not allow policy nomination bcoz of some stupid law that prevents you from changing the beneficiary in the case of divorce (if the beneficiary is your spouse at point of purchase)

This was told by a lawyer when he advised us to make a will...

Assumued HB is older than wife and they don't have children... and both of them didn't make a will...if both of them died at the same time during accident.... because HB is older than wife... they would take it that the HB died first... so all the HB $$$ will go to the wife... and wife also died... all the $$$ for the HB and wife will go to the wife's parents... the HB parents will not get a single cent...

Same thoery apply if the HB is younger.. both their $$$ will go to the HB's parents if they died together...

Thats quite true.. but it also depends.. there has been cases that they get the coroner to establish time of death and if that can be established, then who older also no use.. but that's not the worst.. its estate duties..

imagine husband has 1million... wife has 1 million...

husband found to die first... money goes to wife... estate tax on 1million husband's money.. then tax 2million on wifes money..

crazy.. lol...

just to add. insurance companies like Prudential and AIA are regulated under the Insurance Act.

NTUC is under the Co-op Act.. so they are the only one that can have policy nomination in the policy.

All other insurance company cannot.. you'll have to use either via stat trust or non-stat trust..

what you mention is putting policy under Section 73. that is irrevocable. Non-stat trusts can be changed anytime..

Correct.

That is due to the intestate act coming into play as now the person is married, thus changing his/her marital status. the nomination will not be vaild.

if no new nomination is made then the cpf funds will automatically form part of your estate, which will be distributed according to the interstat law i.e. to your spouse and/or child(ren)
