Need Advice Desperately

Hii..we really need your advice.

This is where my nightmare begins. We bought a house from a couple where one of them is the house agent. They told us no need to engage any house agent to represent us as she (wife) could act as our agent too. She told us she will help with the paper works (but in reality it's not at all, and all the submission done by ourselves), so we r agree to her suggestion.

From the very 1st beginning (viewing house), we told them we need the place as soon as possible and they were saying NO PROBLEM. Come to 2nd viewing, signing OTP we still try to make sure that we can take over the place ASAP and again they were saying NO PROBLEM.

2days before 1st appointment, they called my hubby saying that they need the completion date to be 14weeks because they don't want to pay bank penalty. It was really shocked us cos all of this time we've been thinking that it can be done in 6weeks. We even already told our house owner that we will be moving out by end of July (this is our stupidity) in assumption 6weeks completion+4weeks renovation will fall by end of July.

Of course we reject this. 14 weeks is way too long!!! They told us they will get back again to us but until the day of 1st appointment they didn't give any news again. Thought that our msg is already clear that we want the completion date to be in 6weeks so we didnt follow up them also.

Come to 1st appointment they told us they want the completion date to be 11 weeks. That's still way too long!! The reason they giving still about the their bank issue again and they told us they got no place to stay also. Not try to be drama or mean to them but we can not accept this. First of all my wife is pregnant now and will be delivering on sept. if we agree to be 11weeks+renovation it will finish by end of August. How to shift in when my wife tummy is already getting bigger? and most of all I really worry about the pregnancy. Secondly we have no place to stay also!!

Cut it short..hdb officer suggest to follow hdb time which is 8weeks. But they die die wanted to be 11weeks and refused to sign. Now we headache, so we suggest why not sign 8weeks if they want to stay longer it's fine but by end of July they have to leave..notes renovation will be on going. They rejected! reason being don't want to pay another bank penalty..

Again we suggest..agree to save their *** to put on the paper for completion date on 11 weeks, but notes renovation will be start on the 8weeks. They refused again! Sighhh... (we try so hard to help them but what I see they only thinking about their own interest)

HDB officer seems like had enough to watch us. Sent us out from the room..transaction will be either cancel or postponed to the next available slot which is on July. Whaattt??!! And the wife began to scold us in front of HDB officer. Told us that we has no attitude,never thankfull for what she has done, she helped us a lot, and we don't even bother to return back to her. Wow..this is really inappropriate!!! And again we did everything alone, she just msg what we need to do (is this considering a help? we help ourselves, and what they are doing only helping themselves).

The wife act drama, left the room and never come back. On the other hand, my wife had a thought to cancel..she said not feel good about the house again.

In the end, the couple agree to allowed us doing the renovation only 1 week earlier but we have to agree that the completion date will follow them on the 11weeks. (where got renovation can be done in 1 week??)

Tired and frustrated we agree to do so. They gave us indemnity form.

Now we really regret it. My wife so stress. My question now is.

1. what will be happen if at that time transaction is cancel (cos they dun want to signed follow HDB time)? Will it be better for us? (Deposit return in full amount, and also can we sue for any compensation?)

2. How powerfull is this indemnity form? Been reading up and what I get seems like this form actually just to protect the owner, if anything happen during renovation owner doesn't take any responsibilities.

But what if they not allowed us to do the renovation because of whatever reason? Can this letter force them to do it?

3. My wife totally hate them now. Want to cancel the transaction. What will cost us?

How come no one inputs comments?

Women use right brain more than the left one, so attitude/behaviour/decision making appear to be "dramatic" or temperamentally, which always leave the left brain users in a confused state.

1. From 1st appt to 2nd appt date, maximum is 8 wk. Only the HDB reserves the right to "extend" due to unforsee circumstances.

2. From what u described, I'm 100% sure the "char bor" seller is a "green horn" in real estate property dealing, If she were to insist on 11 wk, why bothered to turnup on the 1st appt date? Sure HDB not allowed! Eventually, did 2 of u sign & fix date on 2nd appt?

3. Once the papers are signed on 1st appt date and 2nd appt date fix (actually still can alter, up to seller/buyer, as long as hdb agrees)the transaction enters into a "irrevocable" state, even either one of the party pass away after 1st and b4 2nd appt.

4. From the way u mentioned indemnity form, I guessed most probably u've signed the papers in 1st appt. Read pt 3 again, if papers signed.

5. If not yet signed and wish to cancel the transaction, lodge an cancellation to resale submission application to cancel the deal.

6. Not worth to engage laywer to get back yr 5k. Let bygone be bygone, story too long to write here, use the left brain to "think".

7. Indemnity form is a form autorised from seller to buyer to "preoccupy" the premises, before the residence title deed exchange hand, in the form of "renovation", however holds the buyer FULLY responsible to any DAMAGES done during that period. My opinion is the, the "mutual trust" between 2 parties MUST be established, otherwise DON'T sign the form, must so rush to do reno? Think of 3rd option.

8. Why don't just spend some $ to rent a place to stay first, and a cheap place to put all yr bulky barang barang? Work out a budget, rather than letting the "anger" dominants the "vision".

Anyway, i'm sort of confused abt yr status - yr wrote "my hubby", then y wrote "my wife is pregnant"?? Basically i'm a left brain user, still get conned by right brain users, at times.
