contra mean the seller can buy right after selling. Some time it happen within days. How to do contra, if he is selling the flat to you and wait for few wks then buy? Since you mention you had submit on 26/03 and base on your checks, the available dates from (mid May -> July 25th) But your actual 1st appointment is 20 Jul. My guess is, the agent ask/choose for the late date. http://askhdb.hdb.gov.sg/Home/hybrid/Theme...&Selected=4 Q: I intend to sell my HDB flat in the open market and buy another resale flat. How can I benefit from the Enhanced Contra Facility (ECF)? A: When you buy your resale flat, all your existing CPF savings in the Ordinary Account will be used to buy the flat. However, if the flat’s resale price is higher than the market valuation, the difference must be paid in cash. HDB will grant you a housing loan after you have used up your CPF savings. The Enhanced Contra Facility (ECF) is jointly implemented by the Central Provident Fund (CPF) Board and the Housing & Development Board (HDB). This facility enables you to sell your existing flat and at the same time buy another resale HDB flat by using the sale proceeds and the refunded CPF monies. With ECF, you can use the CPF monies to be refunded to your account to reduce your housing loan, thereby reducing your monthly loan instalment. If the price of the flat you are buying is higher than the market valuation, you can also use the proceeds from the sale of your flat to pay for the cash outlay instead of paying with your personal savings or taking up a bridging loan.

quote from HDB http://www.hdb.gov.sg/fi10/fi10326p.nsf/w/...nt?OpenDocument The remaining family or single occupier is allowed to retain the existing flat after the owner has passed away, provided: * he / she is a Singapore Citizen or Singapore Permanent Resident (SPR) * he / she is at least 21 years old * he / she satisfies HDB's prevailing eligibility rules and conditions to own a flat Under joint tenancy, if one of the flat owners passes away, the deceased joint-tenant’s share or interest in the flat will be passed on to the surviving joint tenant(s). For example, husband and wife (both above 21 years old) are holding the flat under joint tenancy. If the husband passes away, the surviving wife can take over the flat as the sole lessee if she is a Singapore Citizen or SPR. If the lease had already been issued for the flat, a legal document known as the Notice of Death instrument will have to be prepared and lodged with the Singapore Land Authority (SLA) to allow the authorities to update the land records accordingly. The surviving joint owner(s) may either appoint his own solicitor to act for him in the application or engage HDB's legal services by applying at the HDB Branch Office managing the flat. The procedures for lodging a Notice of Death for flats held under joint tenancy are as follows: * The remaining owner(s) will have to bring along: o Identity card(s) of the remaining joint owner(s) o Original death certificate of the deceased owner o Evidence of estate duty clearance for deceased owner’s estate (for death occurring before 15 February 2008) o Duplicate lease, if any * The remaining owner(s) will also be required to pay the relevant registration fees and conveyancing fees at the point of application. * HDB's Legal Department will then prepare the Notice of Death and inform the remaining joint owner(s) to call at the HDB Hub at Toa Payoh to sign it. Alternatively, the remaining owner(s) can themselves lodge the Notice of Death with SLA. They can refer to the SLA website for more details and information.

Seller Breach Otp Contract
therat replied to habib_ansari's topic in HDB New/Resale Flats, Executive Condominiums
Another HDb quote http://askhdb.hdb.gov.sg/Home/hybrid/Theme...RecordQuestion= Q: Due to unforeseen circumstances, I do not wish to proceed to buy the resale flat. How do I go about doing it? A: Before the first appointment Either buyer or seller may submit a written request to HDB to cancel the registered resale application. After the first appointment Both buyer and seller must agree to the cancellation of the resale application and submit a written request to HDB for the cancellation. This cancellation, however, does not necessarily mean the Option to Purchase becomes void. In the case of a dispute, both parties will have to consult their own private solicitors. -

i guess the best person to advise you is either HDB officer or lawyer. If all the doc is favor to you, your percentage will be higher. Quote from HDB http://askhdb.hdb.gov.sg/Home/hybrid/Theme...&Selected=4 Q: I am a resale flat buyer and I have some disputes with my seller regarding the resale transaction. Can HDB enforce the terms and conditions stated in the Option to Purchase for the seller and buyer? A: Sellers and buyers are contractually bound to complete the sale and purchase once the Option to Purchase is exercised. If either party breaches the terms of the agreement, the other party will be entitled to enforce the terms of the Option for specific performance, damages and/or any other remedy. If there is any dispute, the buyers and sellers may wish to consult a private solicitor on the rights and remedies in the matter. Alternatively, the buyers and sellers may wish to consider settling the dispute through mediation at the Singapore Mediation Centre. You can call them for assistance on the procedures and charges at 6332- 4366. -
